CONSENT TO TERMS OF USE. Access to and use of the services of Ultreia Travel and our website
is subject to acceptance of these Terms of Use (“Terms of Use”, “terms”). By accessing, using or
obtaining any content, products, or services through our offices or through our websites, you agree to
be bound by these terms. If you do not accept all of these terms, you may not use our services or our
websites. Engaging Ultreia Travel or using its websites constitutes acceptance of all Terms of Use,
which govern the relationship between Ultreia Travel and you, the Customer.
NO COPYING OR EDITING. No material from this website may be modified, copied, reproduced,
republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a
derivative work, transferred, sold or distributed in any way, without prior written consent from
Ultreia Travel. You may not frame or mirror any material on this website on any other server or other
location. Unauthorized use of any such material on any other website or computer environment or
elsewhere is prohibited.
PRIVACY POLICY. At all times your information will be treated in accordance with Ultreia
Travel’s Privacy Policy, which is incorporated by reference into this Agreement and can be viewed
at www.ultreiatravel.com
RESERVATION OF RIGHTS: CHANGES TO THESE TERMS. We reserve the right, in our sole
discretion, to change these Terms at any time. Updated versions of the Terms will be posted here on
this website and are effective immediately on posting. Please check frequently, especially before you
use this website, to see if these Terms changed. Use of the website after any changes to the Terms
constitutes your consent to the changes.
ACCESS TO PASSWORD PROTECTED/SECURED AREAS. Access to and use of password
protected and/or secure areas of this website is restricted to authorized users only. Unauthorized
individuals attempting to access these areas of this website may be subject to prosecution.
RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY. We reserve the right to
correct errors and offers are subject to availability.
If any part of these Terms of Use is determined to be invalid or unenforceable pursuant to applicable
law including, but not limited to, the warranty disclaimers and liability limitations set forth above,
then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable
provision that most closely matches the intent of the original provision and agreement shall continue
in effect.
These Terms of Use constitute the entire agreement between the Customer and Ultreia Travel with
respect to accessing our website, and it supersedes all prior or contemporaneous communications and
proposals, whether electronic, oral, or written. A printed version of this agreement and of any notice
given in electronic form shall be admissible in judicial or administrative proceedings based upon or
relating to these Terms of Use to the same extent and subject to the same conditions as other business
documents and records originally generated and maintained in printed form.
COMMENT POSTINGS. You are solely responsible for your own comments, the consequences of
posting those comments, and the consequences of any reliance by you on the comments of others. By
submitting your comment, you hereby give Ultreia Travel the right, but not the obligation, to post,
edit, exhibit, webcast, re-use, publish, reproduce, use, license, print, distribute or otherwise use your
comment(s) and accompanying personal identifying and other information you provide via all forms
of media now known or hereafter devised, worldwide, in perpetuity. Ultreia Travel has no
responsibility for the content of any messages, information or materials uploaded, posted, distributed,
or transmitted by anyone who uses www.ultreiatravel.com. However, Ultreia Travel retains the right,
but not the obligation, in its sole discretion, to monitor, review, edit, delete or refuse to post any
third-party content that Ultreia Travel, in its sole discretion, deems to be objectionable, in violation
of these Terms of Use, or for any other reason or no reason. Ultreia Travel reserves the right to
disclose any information as necessary to satisfy any law, regulation or governmental request.
The content of the Ultreia Travel website, includes without limitation, copyrighted materials,
trademarks and other proprietary information, text, software, photos, video, audiovisual recordings,
graphics, music and sound. The entire contents of the website are copyrighted as a collective work
under the United States copyright laws and/or similar laws of other jurisdictions. Ultreia Travel owns
a copyright in the selection, coordination, arrangement and enhancement of such content, as well as
in the content original to Ultreia Travel. Third-party content providers own the copyright in content
that is original to them.
E-MAIL UPDATES. Ultreia Travel may provide e-mail news service or other prompts to new
content available. Your use of such content received through the e-mail news service will be subject
to these Terms of Use.
ADDITIONS AND CHANGES. You agree to review these Terms of Use on a regular basis to be
aware of Changes (as defined herein) and any notices we may send to you. Ultreia Travel has the
right, at any time, to: (a) add, change or discontinue any aspect or feature of this website and any
other data, including, but not limited to, content, availability and equipment needed for access or use;
(b) impose, change or modify its Terms of Use applicable to your use of the this website,
subscription services, or any part thereof; and/or impose, change or modify the Terms of Use of these
Terms of Use (“Changes”). Such Changes shall be effective immediately upon notice by posting the
Changes on Ultreia Travel’s website or by any other method of notice it deems appropriate.
FOR YOUR INFORMATION. Use of this site is at your own risk. The content is provided “as is”
and without any warranties, express or implied. We disclaim all warranties, including any implied
warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not
warrant that this site will be uninterrupted or error-free, that defects will be corrected, or that this site
or the server that makes it available are free of viruses or other harmful elements. We do not warrant
or make any representation regarding any use of the content or accuracy. We may make changes or
improvements at any time. You assume the entire cost of any loss or damage arising from the use of
this site or its content. We make no warranty that your use of the content will not infringe the rights
of others. We assume no responsibility for errors or omissions in such content.
All of the information on this site is current only as of the date it is posted.
SECURITY AND PRIVACY. Any passwords used for registration on this site are for individual use
only. You may not share your password with anyone. You are solely responsible for the security of
your password and any use of the services by anyone else with whom you share your password. We
may monitor your password and, at our discretion, require you to change it. If you use a password
that we consider insecure, we may require it to be changed or we may end your account.
If you become involved in any violation of system security, we reserve the right to release your
details to system administrators at other sites in order to assist them in resolving security incidents.
We reserve the right to investigate all suspected violations of these Terms of Use.
We reserve the right to fully cooperate with any law enforcement authorities or court order
requesting disclosure of the identity of anyone posting any e-mail messages, or publishing or
otherwise making available any materials that are believed to violate these Terms of Use. By
accepting this agreement, you waive and hold harmless Ultreia Travel from any claims resulting from
any action taken by Ultreia Travel during or as a result of its investigations and/or from any actions
taken as a consequence of investigations by either Ultreia Travel or law enforcement authorities.
GOVERNING LAW. These Terms of Use will be governed and interpreted pursuant to the laws of
the state of Georgia, without reference to conflict of law provisions. You specifically consent to
personal jurisdiction in Chatham County, Georgia in connection with any dispute between you and
us. The parties to these Terms of Use each agree that any dispute between the parties arising out of or
relating to services provided by Ultreia Travel or these Terms of Use, whether under the terms of
agreement between the parties or any applicable law, will be resolved by binding arbitration, on an
individual and not a class-wide basis. You irrevocably waive any rights to bring or participate in any
class action related in any way hereto. No finding or conclusion in any arbitration proceeding shall be
admissible in any other proceeding, and any such finding or conclusion shall be strictly confidential
between the parties. Arbitration costs shall be paid equally by the parties, and a single arbitrator shall
decide all disputes and be empowered to award costs and legal fees as he/she deems appropriate.
Ultreia Travel’s liability in any dispute shall be limited to the amount of any commission or other
earnings it received in connection with the travel services at issue in any dispute. If any part of these
Terms of Use is unlawful, void, or unenforceable, that part will be deemed severable and will not
affect the validity or enforceability of any remaining provisions. The use of the Ultreia Travel
website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms
of Use, including, without limitation, this paragraph. These Terms of Use constitute the entire
agreement relating to this subject matter. Notwithstanding the foregoing, any additional Terms of
Use on this site will govern the items to which they apply. We may revise these Terms of Use at any
time.
RGISTERED TRADEMARK NOTICES. If you are aware of an infringement of our brand, please
let us know by e-mailing us support@ultreiatravel.com. We only address messages concerning brand
infringement at this e-mail address.

by copyright.
The content on this website is provided for information purposes only. While every effort has been
made to ensure the accuracy and completeness of this information, Ultreia Travel makes no

Customer (hereinafter “Customer”, “you”) understands and agrees that Ultreia Travel LLC, (hereinafter
“Ultreia Travel”, “we”, “us”), is an Independent Contractor acting as an Independent Affiliate of Travel
Experts, Inc., dba Travel Experts.
CONTRACT. We draw your attention to the Terms and Conditions of travel below, these Terms and
Conditions including all brochures, documents, correspondence, and the terms and conditions of our
suppliers form the basis of the contract with you. Before making a booking with us you must ensure that
you have read and understood these Terms and Conditions (and ask any questions you may have).
Please be aware that these Terms and Conditions contain waivers of liability as well as
waiver of class action and venue selection and notice clauses. By asking us to confirm your
booking you are accepting all the Terms and Conditions laid out below and acknowledging that you have
read the Terms of this Contract and agree with it.
If you are making a booking as a group, the leader of the group is responsible for sharing these Terms
and Conditions with all members of the group and is financially responsible for the booking. We will not
be liable for a group leader’s failure to share these Terms and Conditions with all Customers in their
group.
You represent and warrant that (a) you are of sufficient age to use our services and website and can
create binding legal obligations in connection with your use, (b) you are legally authorized to act on
behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the
information supplied by you, or members of your group is true and correct.
VIOLATIONS BY YOU. You agree that any violation of any such Terms and Conditions may result in (a)
the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your
reservation or purchase, and (c) your being denied access to the applicable travel related product or
service.
CHANGES TO THESE TERMS AND CONDITIONS. Ultreia Travel reserves the right, in our sole
discretion, to change these Terms and Conditions at any time. Upon making changes, we will notify you
via the email address you provide to us at booking. The most current Terms and Conditions will apply to
your booking. You must therefore be familiar with the Terms and Conditions in effect at the time you
book. Your continued use of our services including continuing to use or maintain any bookings after
notice of any changes to the Terms and Conditions constitutes your consent to the changes.
COVID 19 RELEASE OF LIABILITY. By booking a tour at this time, you acknowledge the highly
contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with
you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or
infection may result in personal injury, illness, permanent disability, and death even if such injuries or
losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that
exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or
eliminated by Ultreia Travel.
You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or
cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which
there may be no refund. You may also be required to quarantine upon arrival in some locations. Some
locations may require you to have a vaccination or proof of negative testing. Stopover countries
requirements will also apply. On your return home, additional testing, requirements, or documentation
may be required. You are responsible for understanding these requirements and must not rely on Ultreia
Travel to provide these details. You understand that you may become sick before, during, or after the
tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation
terms below, for which we will not be liable.
You agree that due to uncertainty caused by COVID 19, Ultreia Travel has strongly encouraged the
purchase of travel protection coverage including cancel for any reason coverage if and when available,
and that should you fail to purchase travel protection coverage, Ultreia Travel shall not be liable to any
losses howsoever arising.
You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns,
personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS
Ultreia Travel LLC, its members, officers, agents, and/or employees, and suppliers (RELEASEES), of from
and against any and all claims, damages, demands, losses, and liability arising out of or related in any
way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY,
DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel
restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR
OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF
ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by
operation of law or otherwise.
SCOPE/AGENCY. Customer understands that Ultreia Travel and Travel Experts are not the source or
suppliers of the travel services you have requested, and act solely as agents for the actual suppliers of
such services. Customer has been advised that the suppliers whose names appear in the information
supplied to him/her are those who are actually responsible for providing the travel services purchased.
Customer consents to and requests the use of those suppliers and agree not to hold Ultreia Travel or
Travel Experts responsible should any of these suppliers: 1) fail to provide the travel services customer
has purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission
that causes customer any sort of injury, damage, delay or inconvenience.
BOOKING/PAYMENT. If you are wondering how to get started, simply make an inquiry by email or
phone. Our contact information can be found on our website. Together we will discuss your travel wants
and needs. If you decide that Ultreia Travel is the right fit for planning your next dream vacation, you will
pay our planning fee and enter into a client agreement with us. We charge a planning fee to help cover
our time and effort for research, management, communication, itinerary development, and support.
Planning fees vary based on trip complexity, duration, and number of travelers as well as lead-time
between proposal request and travel date. Planning fees are non-refundable even if you cancel your trip
or decide not to book. Customer understands that any planning fees paid to Ultreia Travel, or charged by
Travel Experts, are non-refundable and you agree not to dispute or chargeback
any credit card charges pertaining to such planning fees.
Our planning fee does not include airfare and we suggest you not make any air reservations until you
receive confirmation of your trip elements. We outsource flight arrangements to a third party who
charges an additional $75 fee per person roundtrip for domestic flights and $150 per person for
international flights. Your contract for airfare is with the carrier and subject to its terms and we will not
be liable for any change fees or cancellation fees or other additional cost you incur with the air carrier.
After receipt of planning fee, we will begin to design your customized proposal by performing extensive
research to find the best options for you. The proposal may include information about accommodations,
any exclusive amenities, recommended tours and activities (if applicable), and general logistical
information (recommended flights, transportation information, etc.) Availability and rates are subject to
change until the time of booking.
We will then present you with a custom itinerary. Once you’ve had a chance to review, we will begin the
booking process, or revise the proposal if needed. Please note that our consulting fee covers minor
adjustments to the initial proposal; any major revisions may be subject to an additional fee. “Major”
revisions include, but are not limited to, a change in trip dates, a new country/itinerary routing, a change
in budget from what was initially discussed, or additional travelers joining.
Upon booking, we will provide you with instructions of payments and all due dates. Deposits are typically
NON-REFUNDABLE, unless stated otherwise in the terms and conditions of the Supplier. You must make
all payments in full and on time. If you are booking within 60 days of the departure date, full payment
will be due at the time of booking confirmation. If full payment is not received by the due date on your
invoice, we reserve the right to cancel your travel and apply the cancellation charges set out in the
cancellation section below. Failure to make a payment may result in the cancellation of your travel. In
such a case this would be considered a cancellation by you and the cancellation terms and fees as
described below would be in effect.
After the booking is complete and, in the weeks leading up to your trip, we will connect with our travel
partners to alert them of your VIP arrival. We will ensure your reservations are confirmed, your VIP
amenities will be applied (if applicable), and that all partners are fully prepared and informed of your
special trip.
While we do have an additional Concierge Service for extensive booking of a la carte services (i.e.
restaurant reservations, theater tickets, spa appointments, etc.) we are happy to make reservations for
you your first night in each destination, as well as up to 2 additional appointments/reservations
throughout your trip. We ask that all bookings be finalized at least 1 month prior to your date of
departure to allow us ample time to confirm all components.
Two weeks prior to departure we will prepare your customized final itinerary with all trip details and
important travel information for review. We will present these details to you both in PDF format, and in a
mobile itinerary app, which we invite you to download for easy access to your day-by-day itinerary,
contact information, destination guides while traveling. This is your time to
review and ask any final questions.
Please review all documents carefully and promptly as we will not be responsible for any errors. It is your
responsibility to review all travel documentation and alert us as soon as possible with any corrections.
PRICE/RATE INCREASES. Customer understands that any airline tickets, air tours or other products
customer is purchasing are subject to supplemental price increases that may be imposed after the date of
purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or
government. Customer acknowledges that you may be charged additional sums by Ultreia Travel to offset
increased fees, fuel surcharges, taxes, fluctuations in foreign exchange markets or any combination
thereof. Customer hereby consents to any post-purchase price increases and authorizes Ultreia Travel to
charge Customer’s credit card for such additional amounts.
CREDIT CARD BOOKINGS. While we do accept major credit cards including Visa, Mastercard,
American Express and Discover, Customers must authorize every transaction for the trip. Your
authorization is an agreement for us to charge your card and an acknowledgement and agreement to
these terms and conditions including the cancellation terms. As such, you agree not to make any
improper chargebacks.
In certain cases, you can dispute charges with credit card companies ("chargebacks"). Before initiating a
chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will
work with you in attempting to resolve your concerns. By using our service to make a reservation, you
accept and agree to our cancellation policy. Ultreia Travel retains the right to dispute any chargeback that
is improper and recover any costs, including attorney’s fees related to improper chargebacks.
Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation
related to that improper chargeback. The following chargeback scenarios are improper, and we retain the
right to investigate and rebut any such chargeback claims:
Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
Chargebacks resulting from charges authorized by family, friends, associates or other third
parties with direct access to your credit card. This does not include credit card fraud.
Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product
description.
Chargebacks resulting from force majeure or other circumstances that are beyond the control of
Ultreia Travel or the Supplier.
Chargebacks resulting because you do not agree with the cancellation policy.
DESTINATIONS/DOCUMENTATION. Customer further understands and acknowledges that travel to
many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but
not limited to disease, crime, terrorism, and warfare. Because each Customer’s risk tolerance is different,
Ultreia Travel is not in a position to advise Customer whether you should travel to any particular place at
any particular time. Rather, to make an informed decision, Customer should refer to objective third-party
sources of travel information, such as that maintained by the U.S. Department of
State (travel.state.gov). In addition, you should consult with government websites
to ensure that you are following all requirements for admittance into that
country, including COVID- 19 requirements, as well as understanding local laws that govern travel within
a country, such as medical tests and tracking. Should you choose to travel to a country that has
been issued a travel warning or advisory, Ultreia Travel will not be liable for damages or
losses that result from travel to such destinations.
Customer will review your travel documents for accuracy upon receipt and understands you will
contact Ultreia Travel with any question or discrepancies. Customer understands that discounted fares
typically involve restrictions and that changing any aspect of travel arrangements may result in the
payment of additional money or restricted refunds.
Customer understands that the Transportation Security Administration (TSA) requires Customers to carry
a government-issued identification card in order to board a flight. Customer has been advised that the
name, date of birth and gender that appears on your identification card must exactly match the data that
is listed on Customer’s airline ticket and in his/her booking records. Customer acknowledges that any
failure to strictly comply with these requirements may result in denied boarding or an undue delay at an
airport security checkpoint causing Customer to miss your flight. Ultreia Travel bears no responsibility for
advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or
losses including missed portions of your vacation related to improper documentation or government
decisions about entry.
Customer understands that if traveling internationally, you must have a valid passport and, depending
upon destination and nationality, customer may need to obtain one or more visas. Additionally, passports
should have at least 6 months of validity after the Customer’s return date to the US. Children and infants
also require all such travel documents. Minors traveling with one parent, and/or without both parents,
may be stopped and not admitted, unless authenticated and verified consent forms are provided to the
authorities.
Note to Customer: Passport and visa information may be obtained by contacting the Travel Agent Section
of the U.S. State Department at 202.647.5225 or by visiting the State Department's Web site at
travel.state.gov. Non-U.S. passport holders should be sure to contact the embassies of their destination
and transit countries to obtain entrance requirements.
Recommended inoculations and vaccinations for travel may change and you should consult your
practitioner for current recommendations before you depart. It is your responsibility to ensure that you
meet all health entry requirements, obtain the recommended inoculations and vaccinations, take all
recommended medication, and follow all medical advice in relation to your trip. To obtain medical

at www.cdc.gov
INSECTICIDE NOTICE. Customers are encouraged to check the list of countries that require airlines to
treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S.
Department of Transportation’s Web site, as this list is updated from time to time:
https://www.transportation.gov/airconsumer/spray.
CANCELLATION POLICY. Cancellation of travel must be made in writing and is
effective from the date we receive the written notification. Our planning fee is
always non-refundable. Ultreia Travel incurs costs with the suppliers of your trip
well in advance of your departure date. All suppliers have their own cancellation policies, which apply to
your booking. Upon receipt of your cancellation request we will contact the suppliers for any applicable
refunds subject to the supplier’s terms and conditions. If you are entitled to a refund, please note that
the supplier is responsible for this refund, not Ultreia Travel. Suppliers may choose to provide a travel
voucher or credit in lieu of refund. We are not responsible for a supplier’s failure to pay a refund or for
supplier bankruptcy or insolvency.
In addition to the terms of our suppliers, Customer understands and accepts Ultreia Travels cancellation
policy as follows. After Initial Deposit: any cancellation of the itinerary for any reason is subject to a $250
penalty; After Final Payment: any cancellation of the itinerary for any reason is subject to a $500 penalty.
If the reason for cancellation is covered under the terms of your travel protection plan you
may be able to reclaim these charges, for this reason we strongly encourage the purchase of
a travel protection plan including additional cancel for any reason coverage.
Airline tickets are governed by the air carriers’ terms, and we are not responsible for any air carrier’s
decision regarding refund.
CHANGES AND CANCELLATION BY THE SUPPLIER. We will inform you as soon as reasonably
possible if a supplier needs to make a significant change to your confirmed booking or to cancel. We will
also liaise between you and the supplier in relation to any alternative arrangements offered by the
supplier, but we will have no further liability to you.
If between planning time and/or during actual travel, circumstances require changes, Ultreia Travel and
its suppliers, reserve the right to cancel or vary any itinerary and substitute components of any tour,
including but not limited to hotels and accommodations of comparable quality, if air schedule or surface
transportation charges, security matters, and/or other events make such alterations necessary. Suppliers
may substitute transportation equipment depending on any variety of factors, including the volume of
passengers on a tour. During local or national holidays or special events, peak seasons, on certain days
of the week, and during religious occasions, certain facilities such as museums, churches, restaurants,
sightseeing tours, hotels, and shopping may be limited or not available. Alternatives will be offered
whenever possible. Ultreia Travel cannot be held responsible for any closures, necessary itinerary
changes, or curtails for any reason. These changes will not be considered material changes and will not
be consider cause for cancellation by the Customer. Normal cancellation penalties still apply to the tour
that has been changed.
NO REFUND FOR UNUSED ARRANGEMENTS. As Ultreia Travel’s prices are based on contract rates,
there will not be any refund for any unused portion of a travel booking. If you cancel while your trip is in
progress, there is no refund for the unused portion.
FORCE MAJEURE. Ultreia Travel assumes no liability for, any loss,
damage, delay, or cancellation resulting in whole or in part from an Act of God or
any other force majeure condition, including, without limitation: fire, volcanic
eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or
high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil
commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor
disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine
restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of
nature, government seizures, refusal or cancellation or suspension or delay of any government authority
or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or
any other unforeseen circumstances or any other factors unforeseen by Ultreia Travel that impacts
negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances
amounting to force majeure, we will not be required to refund any money to you, although
if we can recover any monies from our suppliers, we will refund these to you without any charge by
Ultreia Travel. Our planning fee is always non-refundable.
NON-RESPONSIBILITY. Ultreia Travel, and its employees, shareholders, agents, and representatives
use third party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services
related to this tour. Ultreia Travel is an independent contractor and is not an employee, agent, or
representative of any of these suppliers. Ultreia Travel does not own, manage, operate, supervise, or
control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies
services related to your tour. All suppliers are independent contractors and are not agents or employees
or representatives of Ultreia Travel. All tickets, receipts, coupons, and vouchers are issued subject to the
terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or
utilizing the services, all Customers agree that neither Ultreia Travel, nor its employees, agents, or
representatives are or may be liable for any loss, injury, or damage to any Customer or their belongings,
or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from
any occurrence beyond the control of Ultreia Travel. Ultreia Travel assumes no responsibility or liability
for any delay, change in schedule, loss, injury or damage or loss of any Customer that may result from
any act or omission on the part of others; Ultreia Travel assumes no responsibility or liability for personal
property; and Ultreia Travel shall be relieved of any obligations under these terms and conditions in the
event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not,
terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine,
medical or customs or immigration regulation, delay, or cancellation. Ultreia Travel accepts no
responsibility for lost or stolen items. Ultreia Travel reserves the right to refuse any Customer or potential
Customer at its sole discretion.
ASSUMPTION OF RISK/WAIVER. Customer is aware that travel such area as Customer is
undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks
include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway
hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic
beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun,
water, and wind; your own negligence and/or the negligence of others, including tour guides, other
Customers, Ultreia Travel and its employees, agents and/or representatives; attack by or encounter with
insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no
available medical services; fatigue, chill, overheating, and/or dizziness,; known or
unknown medical conditions, physical excursion for which you are not prepared
or other such accidents; the negligence or lack of adequate training of any third-
party providers who seek to assist with medical or other help either before or after injuries have
occurred; accident or illness without access to means of rapid evacuation or availability of medical
supplies or services; and the adequacy of medical attention once provided.
Customer understands the description of these risks, including to risks due to COVID 19, is not complete
and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the
enjoyment and excitement of this trip, Customer is willing to accept the risks and uncertainty involved as
being an integral part of travel, including the risk of infection, illness, and death. Customer hereby
accepts and assumes full responsibility for any and all risks of illness, injury or death and of the
negligence of Ultreia Travel and agrees to and shall hold harmless and fully release Ultreia Travel LLC, its
members, officers, agents, and/or employees (together Ultreia Travel) from any and all claims associated
with the trip, including any claims of third-party negligence and/or the negligence of Ultreia Travel and
Customer hereby
covenant not to sue Ultreia Travel for any such claims or join any lawsuit or action that is suing Ultreia
Travel. This agreement also binds your heirs, legal representatives, and assigns. The terms of this HOLD
HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of
this Contract, whether by operation of law or otherwise.
INDEMNIFICATION. Each Customer is expected to act responsibly and adhere to all behavior
guidelines established by Ultreia Travel and our local suppliers. Our local suppliers reserve the right to
remove you from any trip if you endanger yourself or others or disrupt others. In any such case, there
will be no refund.
Customer agrees to and shall indemnify and hold harmless Ultreia Travel LLC, its members, officers,
agents, and/or employees (collectively “Ultreia Travel”), from any expenses, losses, liabilities, damages,
judgments, settlements and costs (collectively, “damages”) involved with or incurred by Ultreia Travel
(including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to
any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i)
Customer’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage
caused by Customer while participating in the trip.
BAGGAGE FEES. Due to continual changes in airline baggage policies, it is suggested that you inquire
with your airline's website for up-to-date fees and information. Ultreia Travel is NOT responsible for
additional fees incurred for baggage or seating.
RE-CONFIRM YOUR FLIGHT. Ultreia Travel advises you personally to re-confirm your flight schedule
within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays.
Most airlines allow you to check in online 24 hours prior to departure.
PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES. It is essential that you
advise us before booking if you do have any disability or pre-existing medical condition which may affect
your tour, or if you have any special requirements as a result of any disability
or medical condition (including any which affect the booking process) so that we
can assist you in considering the suitability of the arrangements and/or in
making the booking. Ultreia Travel will communicate requests to Suppliers, but cannot be responsible if
ADA accommodations are not available. Any accommodations provided will be at the sole expense of the
Customer requiring the accommodation. Please note that accommodations outside of the USA may not be
in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.
Our Suppliers are, unfortunately, unable to offer additional assistance to Customers with limited mobility
and all such assistance will need to be provided by whoever the Customer is traveling with. Customers
with disabilities must notify Ultreia Travel at the time of booking of status and of the identity of their non-
discounted, paid travel companion who will be responsible for providing all necessary assistance. We may
request that you provide a letter from your doctor confirming your fitness to travel.
GOVERNING LAW/JURISDICTION/CLASS ACTION WAIVER/NOTICE OF CLAIM. This
Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and
construed in accordance with the laws of the State of Georgia exclusive of conflict or choice of law rules.
Any claims
shall be brought in a court of competent jurisdiction located in Chatham County, Georgia. You agree that
you will only bring claims against Ultreia Travel in your individual capacity and not as a plaintiff or class
member in and purported class action or representative proceeding. Ultreia Travel shall not in any case
be liable for other than compensatory damages, and your payment of a deposit on a trip means that you
agree to these conditions of sale and expressly waive any right to punitive damages. You understand and
agree that no claims will be considered and that you will not bring suit against Ultreia Travel unless you
have first provided a typewritten notice of claim to Ultreia Travel within 30 days after the tour or
cancellation of the trip.
ENTIRE AGREEMENT & SEVERABILITY. This agreement, including the terms and conditions of our
suppliers, any other documents, including invoices, we provide you, constitutes the entire agreement and
it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or
written, with respect to Ultreia Travel. If any provision of these Terms shall be unlawful, void, or for any
reason unenforceable, then that provision shall be deemed severable from these Terms and shall not
affect the validity and enforceability of any remaining provisions.
TRAVEL PROTECTION. It is the Customer’s responsibility to protect your purchases. For this reason,
Travel Protection Coverage including additional cancel for any reason coverage is strongly recommended.
Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency
Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss
of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a
covered reason such as injury or illness before or during the trip). It also helps with reimbursement for
medical emergency costs (including very costly medical evacuation costs), missed connections and
baggage loss. Travel Protection Plans including cancel for any reason coverage must be purchased within
14-21 days of initial deposit, depending on the insurance provider.
Ultreia Travel is not qualified to answer technical questions about the benefits,
exclusions, and conditions of travel insurance plans. Ultreia Travel cannot
evaluate the adequacy of the prospective insured's existing insurance coverage. If
you have any questions about your travel protection, call your insurer or insurance agent or broker.
Declining to purchase an adequate travel protection plan could result in the loss of your travel cost
and/or require more money to correct the situation. You also acknowledge that without this coverage,
there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without
adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip
protection plan coverage would otherwise have been available.
